Seller Agreement

The TrainFinder marketplace is not yet live. This agreement will take effect when marketplace features launch. Listing fees and terms are subject to change before launch.

1. Overview

This Seller Agreement (“Agreement”) governs your use of the TrainFinder marketplace to list model trains for sale. By listing an item on TrainFinder, you agree to these terms.

TrainFinder is operated by CommandWorks LLC (“we,” “us”), a Texas limited liability company.

2. Fees

• Each listing has a flat fee of $2.99 (or included in your subscription plan)
• Listings are active for 30 days from the date of publication
• You may renew a listing by paying another listing fee
• Listing fees are non-refundable once the listing is published
• A 5% transaction fee applies when your item sells
• Standard Stripe payment processing fees (2.9% + $0.30) apply to each transaction

3. Your Responsibilities as a Seller

• You must accurately describe the item, including condition, brand, model, and any defects
• You must set an honest, fair price
• You must ship the item within the timeframe stated in your listing
• You must respond to buyer inquiries in a timely manner
• You are responsible for all aspects of the transaction: payment collection, shipping, returns, and customer service

4. Our Role

TrainFinder connects buyers and sellers. We are not a party to any transaction between you and a buyer. We do not handle payment, shipping, or returns. We provide the platform; you provide the product and the customer service.

5. Prohibited Listings

You may not list:

• Counterfeit items or reproductions sold as originals
• Stolen property
• Items that are not model trains or directly related accessories
• Items in a condition materially different from what is described
• Items that violate any applicable law or regulation

6. Listing Removal

We reserve the right to remove any listing at any time, for any reason, including but not limited to:

• Violation of this Agreement
• Inaccurate or misleading descriptions
• Buyer complaints about item condition
• Prohibited items

If we remove a listing due to a violation, the listing fee is not refunded.

7. Seller Suspension

We may suspend or permanently ban sellers who repeatedly violate this Agreement, receive multiple buyer complaints, or engage in fraudulent activity. Suspended sellers forfeit any remaining active listings and listing fees.

8. Disputes

Disputes between buyers and sellers must be resolved between those parties. We may assist with mediation at our discretion but are not obligated to do so. We are not responsible for the outcome of any transaction.

9. Limitation of Liability

To the fullest extent permitted by law, CommandWorks LLC shall not be liable for any damages arising from your use of the TrainFinder marketplace, including but not limited to lost sales, shipping damages, or buyer disputes.

10. Modifications

We may update this Agreement at any time. When we do, we will update the “Last updated” date and notify active sellers by email. Continued use of the marketplace after changes are posted constitutes acceptance.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
