1. Who We Are
TrainFinder is operated by CommandWorks LLC (“we,” “us,” “our”), a Texas limited liability company. TrainFinder is a price comparison and discovery platform for US O gauge model trains.
2. What the Service Does
TrainFinder aggregates product listings and prices from third-party retailers, eBay, and individual sellers. We display this information so you can compare prices and find the best deals on O gauge trains. When you click a link to buy from a seller, you leave TrainFinder and complete your transaction directly with that seller.
In the future, TrainFinder may offer a marketplace where individual sellers can list items directly on our platform. Those transactions will be governed by additional marketplace terms.
3. Your Responsibilities
- You must provide accurate information when creating a watchlist, submitting a review, or listing an item for sale.
- You must not use TrainFinder for any fraudulent, deceptive, or illegal activity.
- You must not scrape, crawl, or otherwise automatically access TrainFinder except through our published API (if any).
- You must not interfere with the operation of the service or other users' use of it.
4. Our Responsibilities
We make a best effort to display accurate, up-to-date pricing information. However, prices are sourced from third-party sellers and can change at any time without notice. We do not guarantee the accuracy, completeness, or timeliness of any pricing data.
Always verify the price on the seller's website before completing a purchase.
5. Accounts
TrainFinder currently uses email-based identification for features like watchlist sync and seller reviews. No password is required. You are responsible for maintaining access to the email address you provide. We may introduce full account creation in the future.
6. Prohibited Items
The following may not be listed, sold, or promoted through TrainFinder:
- Counterfeit or reproduction items sold as originals
- Stolen property
- Items that are not O gauge model trains or directly related accessories
- Items that violate any applicable law
7. Disputes
Transactions occur between you and the seller. TrainFinder is not a party to any purchase. If a dispute arises, you must resolve it directly with the seller. We may assist with mediation at our discretion but are not obligated to do so and do not guarantee any outcome.
8. Limitation of Liability
To the fullest extent permitted by law, CommandWorks LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of TrainFinder. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is less.
9. Disclaimers
TrainFinder is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Modifications
We may update these terms at any time. When we do, we will update the “Last updated” date at the top of this page. Continued use of TrainFinder after changes are posted constitutes acceptance of the revised terms.
11. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
